لا شكّ أنّ المرأة هي الأمُّ الحَنُون والابنة الرقيقة والأخت الرؤوم والخالة والعمّة الرَّزَان، والزوجة الحَصَانُ التي هي في حياة الرجل أهمّ مخلوق؛ فهي السكن والمودة والرحمة، وهي المُعِين في إدارة حياته. ولقد كانت المرأة -ولا زالت- مخلوقًا عجيبًا احتار الفلاسفة في فَهْمِه وتعريفه؛ إذ إنّ أسراره لا تنقضي، وعجائبه لا تنتهي، وسَبْر أغواره مُحَالٌ. ولمّا كان الأمر كذلك فقد كانت المرأة حَقْلًا خِصْبًا للدراسات الجادّة التي تنظرُ كلّ منها إلى المرأة من زاوية تختلف عن الأخرى، حسب طبيعة القضايا المطروحة.
-المرأة في اليهودية: تعتبر اليهوديّة المرأة أصل الشر في العالم، أو هي المسئولة عن الخطيئة البشرية الأولى؛ لأنها -بزعمهم- هي السبب في خروج آدم عليه السلام من الجنة، ونرى ذلك بوضوح في التوراة: ”وكانت الحيّةُ أَحْيَلَ جميع الحيوانات البريّة التي عملها الربّ الإله، فقالت للمرأة: أحقًّا قال الله: لا تأكلا من كل شجر الجنة؟ فقالت المرأة للحيّة: من ثمر شجر الجنة نأكل. وأمّا ثمر الشجرة التي في وسط الجنة، فقال الله: لا تأكلا منه ولا تَمَسّاه؛ لئلا تموتا. فقالت الحيّة للمرأة لن تموتا. بل الله عالم أنه يوم تأكلا منه تتفتح أعينكما وتكونان كالله عَارِفَيْنِ للخير والشر... فأخذت من ثمرها وأكلت وأعطت رجلها أيضًا معها فأكل... فقال الربّ الإله للحيّة: لأنّكِ فعلت هذا ملعونة أنتِ من جميع البهائم، ومن جميع وُحوش البريّة... وقال للمرأة: تكثيرًا أُكَثِّرُ أتعاب حبلك، بالوجع تلدين أولادًا.
-المرأة في المسيحية: في المسيحية نجد أن بولس: - اعتقد أن حَوَّاء هي التي أخطأت أوّلًا، ثم أغوت آدم فانقاد وراءها وأخطأ ثانيًا- أوصى جميع الذي خدمه -رجالًا، ونساءً- أن يُسلّم بعضهم على بعض بقبلات مقدسة!
ولذا نقول إن دراسة حقوق الأسرة لها أهميتها التي لا يمكن أن ينكرها أحد، لأنها ترتبط بحياة الإنسان في سائر أحواله وعلى كل مراحل حياته، فالإنسان أي إنسان لابد أن تثبت له هذه الحقوق التي يأخذها وتكون من حقه، وكذلك يقابل هذه الحقوق التي له واجبات يتعين عليه الوفاء بها وأداؤها، فالإنسان لا يخلو من أن يكون أباً أو ابناً أو زوجاً
ويتبين لنا من هذا أن الأسرة هي الخلية الأساسية لأي مجتمع، فصلاح المجتمع وفساده يكون بصلاح الأسرة وفسادها، وكذلك قوة المجتمع وضعفه يكون بقوة الأسرة وضعفها، لذا عنيت الأديان السماوية بالأسرة وحقوقها وواجباتها اعتناءً كبيراً مما يحقق لها الوجود والاستقرار والدوام؛ فشرع لها من الأحكام والحقوق التي يحفظها من كل العواصف التي قد تعصف بها، ومن أي تشتيت لأفرادها وأي شيء يؤدي إلى تدميرها.
ترجع أهمية هذا البحث إلى دراسة وتحليل أهم التشريعات الخاصة بحقوق الأسرة اليهودية والمسيحية باعتبارهما أدياناً سماوية والمقارنة بينهما. وكذلك بيان ما تحتويه الشريعة اليهودية والمسيحية من حقوق متعلقة بالأسرة.
الأسرة في اليهودية: لها منزلة وقداسة كبيرة وذلك لأن الأسرة هي الأساس الأكبر في تكاثر عدد اليهود وزيادة أعدادهم والمحافظة على نسلهم ولذلك جاء من سفر التكوين
فهاتين الآيتان فيهما توضيح بأن المراد من الزواج وتكوين الأسرة هو التكاثر الذي يتعلق في المقام الأول بالأطفال الذين يجدون شكل والديهم روحيا وأخلاقياً، وتحتل الأسرة مكانة مهمة في الشريعة اليهودية، حيث تعدُّ الأسرة هي الوحدة الأساسية في المجتمع اليهودي. وتركز الشريعة اليهودية على تعزيز الحياة العائلية الصالحة والمستقرة، وتشجيع الزواج والإنجاب والتربية الصالحة للأبناء، وتتضمن الشريعة اليهودية العديد من الأوامر والتوجيهات المتعلقة بالأسرة، بما في ذلك متطلبات الزواج والطلاق ورعاية الأبناء وتحديد الوراثة وغيرها. وتعتبر الأم المستقرة والرحيمة والمسؤولة عن تربية الأولاد هي الأساس الذي تقوم عليه الأسرة في الشريعة اليهودية.
وتعتبر الزوجة في الشريعة اليهودية شريكًا متساويًا للزوج، ويتوجب على الزوج المحافظة على حقوق زوجته وتوفير وسائل الراحة والأمان لها ولأبنائهما. كما يتعين على الزوجة الإسهام في الحياة الزوجية وتوفير بيئة صالحة للعيش والتربية. ويعتبر الزواج في الشريعة اليهودية عقدًا
مقدسًا بين رجل وامرأة، يتم بناءً على الحب والاحترام والتزام الزوجين ببعضهما البعض. وتتضمن مراسم الزواج العديد من الصلوات والتعاليم الدينية، وتعتبر مراسم الزواج جزءًا مهمًا من الحياة الدينية لليهود.
دور الأسرة في المسيحية: الأسرة المسيحية هي التي يكون كل أعضاؤها مسيحيين، وتتسق مع المبادئ الكتابية، ويدرك كل أفرادها الدور المرسوم له من الله ويقوم به، والرسول بولس وصف الأسرة المسيحية بالكنيسة الصغيرة، والأسرة المسيحية لها صفات أساسية كما ذكرها القمص أغناطيوس وهي: أن تكون مقدسة بنعمة الرب وجهاد الإنسان، وأن تكون متحابة، وأن يعمل أفرادها على تبادل الاحترام لبعضهم، وأن يعمل كل فرد فيها على تنمية الحياة الزوجية إن الأسرة جزء لا يتجزّأ من المجتمع ومن الكنيسة. فهي تشكلّ أغلى القيم الإنساني، فهي ليست وليدة الصدفة، بل هي مؤسسة وضعتها حكمة الله الخالق لكي يحقّق في الناس مقاصد حبه. فالأسرة إذاً مؤسسة طبيعيّة من وضع الله لا من وضع الإنسان والله نفسه هو الذي جعل في طبيعة الإنسان القوانين والسنن اللازمة والكفيلة بتحقيق مخططه الإلهي، والتي تدعوه لعيش المساواة الكاملة بين الرجل والمرأة والتكامل بينمها.

- Women in christianity: In christianity, we find that Paul: - He believed that Eve was the one who sinned first, then she seduced Adam, so he succumbed to her and sinned again - He commanded all those who served him - men and women - to greet each other with holy kisses!
Therefore, we say that the study of family rights has its importance that no one can deny, because it is related to human life in all his conditions and at all stages of his life. He must fulfill it and perform it, as a person is not without being a father, son or husband
from this it becomes clear to us that the family is the basic cell of any society. The goodness and corruption of society is in the goodness and corruption of the family, as well as the strength and weakness of society is in the strength and weakness of the family. Therefore, the heavenly religions have taken great care of the family and its rights and duties, which achieves its existence, stability and permanence. So he legislated for it the rulings and rights that protect it from all the storms that might afflict it, and from any distraction of its members and anything that leads to its destruction.
The importance of this research is due to the study and analysis of the most important legislations related to the rights of the Jewish and christian families, as they are divine religions, and the comparison between them. As well as a statement of the rights contained in the Jewish and christian law related to the family.
The family in Judaism: It has a great status and sanctity, because the family is the greatest basis for multiplying the number of Jews, increasing their numbers, and preserving their offspring, and for this it came from the Book of Genesis
These two verses clarify that what is meant by marriage and family formation is reproduction, which is primarily related to children who find their parents’ spiritual and moral form. The family occupies an important place in Jewish law, as the family is the basic unit in Jewish society. The Jewish law focuses on promoting a good and stable family life, encouraging marriage, childbearing, and a good upbringing of children. The stable and compassionate mother, who is responsible for raising the children, is the foundation on which the family is based in Jewish law.
In Jewish law, the wife is considered an equal partner to the husband, and the husband must preserve the rights of his wife and provide comfort and security for her and their children. The wife must also contribute to marital life and provide a suitable environment for living and education. Marriage in Jewish law is considered a sacred contract between a man and a woman, based on love, respect, and the commitment of the spouses to each other. The marriage ceremony includes many prayers and religious teachings, and the marriage ceremony is an important part of the religious life of the Jews.
The role of the family in christianity: The christian family is one whose members are all christians, and it is consistent with the biblical principles, and all its members are aware of the role ordained for them by God and they fulfill it. It is sanctified by the grace of God and man’s strife, and it is to be loving, and its members work to exchange respect for each other, and each member of it works to develop marital life. The family is an integral part of society and the church. It constitutes the most precious human values, as it is not a result of chance, but rather an institution established by the wisdom of God the Creator in order to achieve in people the purposes of His love. The family, then, is a natural institution established by God, not by man, and God Himself is the one who placed in the nature of man the necessary laws and norms that ensure the realization of his divine plan, and which call him to live complete equality between men and women and complementarity between them
