لفقه الأولويات وضوابطه أهمية كبيرة في معرفة ترتيب الأعمال وأسس تقديم بعضها وتأخير البعض الآخر، وقد غني المذهب الحنفي بكثير من المسائل التي يمكن استنباط ضوابط فقه الأولويات منها؛ وذلك لخصائصه وطبيعة تكوينه. وكتاب المبسوط للإمام السرخسي مصدرٌ خصبٌ لتلك المسائل، فجاءت الدراسة معنيّة بتتبع مسائل الأولويات في كتاب المبسوط، واستنباط ضوابط فقه الأولويات عندهم منها، باستخدام المنهج الوصفي القائم على استقراء المسائل ومن ثَم تحليلها، والمنهج الاستنباطي للوصول لضوابط فقه الأولويات عند الحنفية، ومن ثَم بيان العوامل المؤثرة في ترتيب فقه الأولويات لديهم، كأصول الفقه الحنفي وقواعده اللغوية، وحكمة الشريعة ومقاصدها، وفقه الموازنات، وسد الذرائع، وفقه الواقع، وغيرها من المؤثرات، كما توضّح الدراسة ما قد يُبنى على تلك الضوابط من مسائل في الفقه الإسلامي المعاصر إن وُجدت؛ تأكيدًا على أهمية فقه الأولويات وضرورة فهمه، والدراسة تقتصر على عدد من النماذج؛ إذ ليست الدراسة إحصائية، وإنما المقصود منها عرض النماذج المعبرة عن سياقات فقه الأولويات، كما لا تكتفي الدراسة بكتاب المبسوط، وإنما تذكر كتب المذهب الحنفي الأخرى عند الحاجة إليها في فهم معايير الأولويات ومصادرها؛ تحقيقًا للهدف الرئيس من الدراسة وهو الوصول إلى ضوابط فقه الأولويات وأسسه عند الحنفية.

Thesis Summary
The study addresses in the controls of the jurisprudence of priorities and its fundamentals in the Hanafi School, by addressing the book Al-Mabsoot by Imam Al-Sarakhsi, which is considered an encyclopedia in which Al-Sarakhsi explained the books of “Zahir Al-Riwaya”.For this reason, it can be said that it is one of the pillars of Hanafi jurisprudence, so it came rich in issues, reflecting what it contains of introducing and delaying actions according to the dictates and requirements of the jurisprudence of priorities.
The study aims to present a number of models of jurisprudential issues in the various chapters of jurisprudence, and to determine the place of priority in them, and then follow the controls affecting them and devise them, link them to other sciences of jurisprudence and Sharia and their branches, such as the origins of Hanafi jurisprudence and its linguistic rules, the wisdom of legislation and the purposes of Sharia, the jurisprudence of budgets, the jurisprudence of outcomes and blocking pretexts“Sadd Al-Dhara’”, the jurisprudence of reality and others, with an explanation of the impact of this on contemporary jurisprudence, if any; Emphasizing the importance of jurisprudence of extreme priorities and the need for it.
The study is based on the descriptive approach based on extrapolating the issues that show the impact of the jurisprudence of priorities and then analyzing them, as well as the deductive approach to reach general controls for their jurisprudence of priorities.For the limitations of the study, it is limited to a number of models selected from the chapters of the book. The study is not statistical, but it is intended to present models expressing the contexts of the jurisprudence of priorities.The study was not satisfied with the book Al-Mabsoot alone, but it was necessary to refer to other books of the Hanafi school when needed in order to understand the jurisprudence of priorities and tighten its controls in every issue, in order to achieve the main objective of the study, which is to reach the controls of the jurisprudence of priorities in the Hanafi school.
The study is divided into an introduction, a preface, and four chapters, followed by a conclusion, and then the sources and references are established, as follows:
