المستخلص

This study deals with the issue of assaulting people in themselves, their bodies and their property, through the cases of the records of the Egyptian Sharia courts, with the discussion of the judicial rulings decided by the judges of the Shari’a courts in reparation for the harm that befalls man as a result of this aggression, and comparing them with the provisions decided by Islamic Sharia and Egyptian law in this chapter. The study aims to stand on the general framework that was invoked by the judges of the Sharia courts in their decisions in cases of aggression in all its forms and figures, as well as to identify the features of jurisprudential and judicial renewal in the Ottoman Empire, and to know the extent of the impact of the practical application aspect of jurisprudence on fixed and stable jurisprudence opinions, and to know the extent of the impact of social and economic development on jurisprudence and judicial rulings. It was found that the points of convergence between jurists and judges are a lot, and that the purposes of Islamic Sharia, especially the purpose of justice, were the ruling criterion and the judicial principle on which the judges based their judicial rulings. Therefore, jurisprudential and judicial efforts must be combined in order to carry out a joint judicial jurisprudence work so that they can provide a codified doctrinal material for judges and those in charge of governance affairs to help them decide various dispute cases in in accordance with the provisions of Islamic Sharia and its general purposes.
