Women occupied a distinguished social and religious position in different eras, and the most important matters in life affairs and that position in different times, in the early stages of history in its history in the rank of gods and mercy, women had the right to divorce and the right to care for children and the right to commercial cooperation in the right to care and alimony. Before Islam ; Occasions and occasions, occasions and occasions, Muslim and Muslim women have welcomed their entire basic laws, and with the passage of time and change, change in the cause of difference all over the world, and faced various changes throughout the legal area and do not change their laws in the laws and laws towards the laws and laws of the United Nations Various laws speak of their legal rights. After the issuance of the law, after the completion of the Human Rights Law, and its special value, including women’s rights, discussed them, and their effectiveness, actors, actors, actors, actors, actors, the gift of states and the freedoms of war, the children of neighboring countries regarding the small war, the children of Arab countries, Arab countries, other countries, Arab countries, Arab countries, other countries internal legal by national courts The importance of women in society lies in a vital topic and that the faces of women in the status of equality are not seen from the perspective of gender equality in the Libyan Basic Law. Iran does not bear fruit, the continuation, the continuation of this demand. Indicate that activity is happening faster in countries; egalitarian equality of women and men in tourism in india engineering, employment, property rights, vice property, vice, dash, protection from gender equality from society from society Libyan women live in society, and they enjoy great gains in rights, especially at this stage in the history of Libyan society, so their status and legal status have been strengthened, in the interest of society to provide social protection and support for them, and the Libyan project addresses all members of society without discrimination or differences between them Everyone, males and females, are equal in rights and duties. The Libyan legislation derived from Islamic Sharia guarantees the protection of all women’s rights, placing them in an equal position with men in order to ensure their social security within the family institution and in society as a whole. Laws of women’s social life at marriage are regulated by special legislation guaranteed by law Personal Status. The inheritance system that the Islamic religion brought is an innovative and unique system that no human being has ever dealt with before. This system has been established on clear foundations and for clear goals, and not in an arbitrary manner in which the legislator took into account the interests of all; Since the Islamic Sharia looked at the woman with a view of mercy, it enjoined on her rights until she had more rights than the man in terms of the sentence, and she had fewer duties than the man in terms of the sentence, and in order to preserve the rights he created provisions that prevent the manipulator from evading, and he came up with legislation that did not reach Humanity with its modern civilization to its shore. Inheritance is a socioeconomic system within a society; Islam imposed it on just foundations and clear rules within society to preserve it, as inheritance is one of the most important sources of ownership of money around which people’s transactions revolve among themselves, and if its provisions were not clear, chaos would prevail within the family. There are principles upon which the inheritance system was established as an economic system to maintain the social order, including: cooperation and affection; As the distribution of the inheritance by the owners of kinship and marital relations in the eyes of Islam unites the hearts and unifies their directions, which makes each individual keen on the good of the other who will benefit him or one of his relatives, this is unlike if the system of inheritance is limited to one party; Because this leads to hatred and the disintegration of families, as well as the principle that inheritance achieves social security within the family; where the right of the young, orphan, widow or others is not lost and they do not become a burden on the community, in addition to establishing the inheritance on the basis of justice and accuracy, i.e. observing the need; where Islam made the difference in inheritance based on need. As long as the need is greater, the amount of inheritance is greater, and this is the reason why the children’s share is greater than the parents’ share. Because the children’s need is greater when they are young, and observing the need is what made the share of the male double that of the female. Because the requirement of cooperation in family burdens places the financial costs of the family on the husband and the father. The man is required to spend on his wife and children and on the relatives of the poor. As for the woman, she is not charged with anything from the burdens of life, and giving her half is just a precaution to prevent what she becomes and falls into when she loses the source of spending. Therefore, Islam did not consider the woman in the ruling on her inheritance in terms of her gender as a woman, but rather in terms of the economic burdens and consequences imposed on her and on the man. Social custom is an important axis in the local culture system, and it contains many virtuous values, which do not contradict religion, but remain custom. Therefore, in terms of the formation of modern society and the state of institutions, custom is given a high degree of domination over women to the point of equality with religion and digests many rights The woman who is guaranteed by Sharia, we find that behind her loss is custom, for example, many women do not take their right to inherit, but are deprived of it under the penalty of custom, and when she commits any crime, we find that she is fully qualified to deserve punishment by the system. The behavior of individuals, both men and women, but in Libyan society, this was not satisfied with women; As it has become a strong rival to many legislations and regulations, it has become a dominant figure, as it prevents women from inheriting. Therefore, we must not stick to our outdated ideas, abandon our bad habits, and follow the laws established by Sharia, those related to women’s rights, the most important of which is inheritance. from women and men to the money of their relatives, because of its positive social and family effects, as well as economic ones that lead to improving the material situation, especially for those who need to obtain their right to inheritance, despite the fact that Sharia guaranteed women their right to inheritance, and came to give them what the Holy Qur’an stipulated. However, there are those who did not care about that, penetrating all the legal texts, in the name of customs and traditions, as they are above the law in their view. So, Sharia is fair to women, but there is a group that has violated this law and continued to rob the heirs of the rights of the heirs under false pre-Islamic claims, and this is embodied by the noticeable increase in the number of cases presented to tribal sheikhs and religious scholars, in which women complain about the theft of their right to inheritance. from this point of view, and in view of this, the researcher considered that there is an urgent need to study it in an attempt to reveal the social and economic dimensions of depriving women of the inheritance of the town of Bani Walid in Libya, and based on this general idea, the researcher tries to clarify the study problem, its importance, objectives, and questions, Concepts, and analytical guidelines for the study, in addition to previous studies. The main objective of this study stems from identifying the social and economic dimensions of depriving women of inheritance in the town of Bani Walid in the Libyan society, and then the study question: What are the social and economic dimensions of depriving women of inheritance in the town of Bani Walid in the Libyan society?
