Scientific progress and technical and technological development in modern society have led to the emergence of many modern technologies that have provided humankind with more luxury goods that have facilitated human life and brought it greater prosperity, which has become indispensable. At the same time, however, these new technologies carry inherent threats to human life, which are difficult to detect because of the inability of those who are harmed to know the specifics of their technical matters. These risks have been exemplified in the damage caused by modern industrial and technological activities such as electromagnetic damages.
This seemed to be an urgent need to address these emerging risks and regulate the responsibility arising therefrom. civil liability, bearing in mind that the general rules of civil liability based on the notion of error, It is no longer enough to be captured, and it is no longer keeping pace with today’s evolving industrial and technological developments. The fact that an error is no longer the sole basis for liability is consistent with the conditions created for these risks. which may cause damage for which it is difficult to prove wrong and to identify the perpetrator, as a consequence of the loss of the injured persons’ rights, which prevent the rules of justice from leaving them without compensation, This necessitates an indication of the need to create a new type of liability in order to keep pace with the risks created by technological development, based on the idea of ensuring risks rather than error, as well as the need to make the necessary amendments in national legislation for liability for the resulting from the Electromagnetic damages caused by the adoption of the strict liability To provide the necessary protection for those affected from the risks and damages of these modern technologies.
