المستخلص The research paper addresses the topic of ””Legal Obligations of States towards Asylum Seekers”” and explores the legal obligations that states have towards individuals seeking asylum. The study aims to analyze the legal framework governing the rights and protection of asylum seekers and the corresponding duties of states, as defined by national legislation and relevant international treaties. The study involves a review and analysis of international treaties and laws related to the right to asylum and refugee rights, such as the 1951 Geneva Convention and the 1967 Protocol. National legislation of states and judicial practices concerning asylum and refugee rights are also examined. The study highlights that states bear a set of legal obligations towards asylum seekers. These obligations include protecting the rights of refugees, ensuring safe residence and access to justice and essential services, including healthcare and education. States are also required to provide effective procedures for assessing asylum claims and allow for fair judicial review. The study emphasizes that states must adhere to principles of non-refoulement, non-torture, and humane treatment of asylum seekers. States should also enhance international cooperation and coordination with human rights organizations and the United Nations High Commissioner for Refugees to ensure refugee rights and meet their needs. Based on the findings and recommendations, states should improve their national asylum systems and enhance legal protection for asylum seekers. Adequate resources must be provided to implement legislation and train staff in the effective application of legal procedures. There is also a need to raise public awareness about refugee rights and combat racism and discrimination. In summary, the study sheds light on the legal obligations that states have towards asylum seekers, including refugee rights and protection. States should ensure safe residence, access to justice, and essential services. Legal obligations also encompass asylum claim assessment procedures, non-refoulement, and prevention of torture. International cooperation and coordination with human rights organizations are crucial to protect refugee rights. The study recommends improving the asylum system and raising public awareness about refugee rights and combating discrimination.” |
