• Experience has agreat role in the uprightness of justice. The judge mustn’t drpuize experts except the tehnical offairs that is away from his specialism . According to the meaniny, I approached to these results :
- Experience is considered a kind of proofs so the jude isn’t allowed to deputize experts except at the complex technical affairs .
Also the expert has to have full conditions from scientici efficiency, integrity and honesty before appointing.
The expert also must submit to the civil and criminal responsiblitiy or disciplinary in case of vilations that need any of these responssibilities.
Islamic canon has achknown work according to experience and there are many proofs from the Holy Book, Sunna and the companions’ deeds.
