This Study which entitled” Sharea’ Courts in Egypt 1301-1375H/ 1883-1955A.D” is considered one of the studies that concerned with the Egyptian judge ship in the era the study talked about. The Study consists of a preparation and four main parts, then a Conclusion that has the important results of the study. The preparation talked about judge ship Conditions in the Ottoman Egypt as Sharea’ Courts (Islamic Courts) were Considered as the first place for the litigants in Ottoman Egypt. Then, when The French occupation came, Napoleon and Meno entered anew kind of courts which were the Commercial Courts. They Sharea’ Courts work too.
At the era of Mohammad Ali, The Hanafi doctrine was the applied one for rendering judgments, Ruler Said was the first to organize the rules of ordering procedures in Sharea’ Courts. Then, there were many kinds of courts had been entered beside Sharea’ Courts. Then many kinds of Civil Courts were entered beside Sharea’ Courts.

The first part entitled ” The Rules of Sharea’ Courts at the era of Egyptian Khedieve 1883-1914 A.D ” It concerned about organizing the Sharea’ Courts according to the way of work, or daring the hearings, the terms of judges appointment and the tasks of these courts. In the era of Khedewy Abass Helmy II Sharea’ courts were characterized by specification according to place, time and judgments. Sharea’ courts low was only concerning about the cases of personal status, endowments, gift, bequest and inheritance.
The Second part entitled ” The relations between Sharea’ judge ship and policy in Egypt 1883-1914 A.D” It talks about Sharea’ judge ship situation of the enterference of politicains and rulers in it’s work . The part talks also about the chef judge prestige in Sharea’ courts it also talks about westering and foreign culture and it’s effect in the Sharea’ courts in Egypt.
The third part entitled ” Sharea’ courts in 1914-1930A.D” It talks about the royal era in Egypt. Legistators took cane about Sharea’ courts. Many judgments had been rationed from all the Islamic doctrines. Also, There was an expansion to establish Sharea’ district courts (courts of first instance) in the governorates of Egypt in order to facilitate it for litigants. The number of Shariah courts with it’s different stages were increased to be more than 110.
The fourth part tittled in ” Sharea’ courts from the rule of 1931A.D till it’s cancellation in the year 1955A.D” It concerned about Sharea’ legal profession and the law of inheritance, bequest and endowment. After the cancellation of private and mixed courts, Sharea’courts became an independent configuration in the year 1949A.D. Then Sharea’ courts were can celled and it’s work was tranced to the National courts in 1955A.D.
