This study looks at explaining the importance of preliminary contracts with a major role in the process of concluding contracts, which was the choice of the promise to contract as a general rule and the promise to sell as a study in protecting the buyer in selling the property under construction to prepare and prepare the final contract.
As well as to determine the extent of its mandatory power in the pre-contracting stage, and the extent of the need to regulate this contract in laws that were not regulated by the Egyptian legislator.
The sale of the property under construction was contrary to its reality, as both the seller and the buyer were treated as a traditional sale. While the researcher concluded that this sale did not set up a special regulation by the Egyptian legislator and subjected it to the general rules that treat it as the primary sale, without taking into account that this initial sale is immediate implementation, while the sale of the property falls under the preliminary agreement and a promise for the future. Jurisprudence and the judiciary also tend to include a promise to contract with the option condition, while the researcher concluded that the Egyptian legislator did not put a general ruling regulating the option clause in the civil group, but it was not without the presence of some applications that it considers to be special forms of the option of the condition, while the promise
