بعد هذا العرض السابق يتبين لنا الطابع الفريد للشريعة الإسلامية - من حيث أصولها ومصادرها وأساليبها فى استخلاص الأحكام وتطبيقها - أمراً جلياً، ومع ذلك فلا تزالُ الشريعةُ الإسلاميةُ هى الحجر الأساس الذى يقوم عليه الإسلام, وأحدُ الأنظمةُ القانونية فى العالم اليوم. فأحكامُها تُخاطب جميعَ أفراد البشريةِ وكافة الجماعات البشرية فى كل مكان وأى زمان، وأيضاً تتضمن أحكام النظام الداخلى وأحكام النظام الدولى, وبفضل الخصائص الفريدة التى بها الشريعة الإسلامية كانت هى المصدر الرئيسى الذى تغذى عليها قواعد القانون الدولى العام.
وقد بَيَّنْتُ ذلك من خلال هذا البحث بعنوان ”أثر الشريعة الإسلامية فى تطوير قواعد القانون الدولى العام” وتَنَاوَلتُه من خلال ستة فصول.
بَيَّنْتُ فى الفصل التمهيدى العلاقة بين الشريعة الإسلامية والقانون الدولى العام، واتضح أن الشريعة الإسلامية تقومُ على تنظيمِ أمورِ الدين والدنيا معاً،ً وأن لها فضل المبادرة فى العناية بأمر تنظيم العلاقات الإنسانية بين مختلف الجماعات، وأن ما استقر عليه الفكر البشرى فى صياغة قواعد القانون الدولى العام هو نتاج ما خَلُصَتْ إليه القواعد والمبادئ التى تضمنها الشريعة الإسلامية.
وتَنَاوَلْتُ فى الفصل الأول دور الشريعة الإسلامية فى إنشاء قواعد القانون الدولى العام، وَوَضَحَ بجلاءٍ أن مصادر القاعدة الدولية فى القانون الدولى العام مستمدةٌ بصورةٍ واضحةٍ من المصادر الأصلية والتبعية للقاعدة الدولية فى الشريعة الإسلامية.
وتَنَاوَلْتُ فى الفصل الثانى دور الشريعة الإسلامية فى تطوير القواعد التى تحكم النظام الدولى، وتبين أن الشريعة الإسلامية ساهمت بشكلٍ واضحٍ فى إنشاء كثيرٍ من القواعد الدولية الحديثة فى كثيرٍ من المجالات, وكذلك القواعد التى تحكم العلاقات الدولية.
وبَيَّنْتُ فى الفصل الثالث دور الشريعة الإسلامية فى إنشاء المبادىء العامة للقانون الدولى العام، وأن الشريعة الإسلامية تتضمن مبادىءٌ تتفق وتنسجم مع بعض المبادىء العامة للقانون الدولى العام، ومن هذه المبادىء مبدأ التعايش السلمى، ومبدأ عدم التدخل فى الشئون الداخلية للدول، ومبدأ سيادة الدول، وكيف أثرت الشريعة الإسلامية وكان لها الفضل الكبير فى إنشاء وتكوين تلك المبادىء.
وتَنَاوَلْتُ فى الفصل الرابع أثر الشريعة الإسلامية فى تطوير قواعد القانون الدولى الانسانى فى القانون الدولى العام، وتبين أوجه التشابه بين المبادىء التى يرتكز عليها القانون الدولى الإنسانى وأحكام الحرب فى الإسلام، وأن هذين النظامين القانونين يصبوان لتحقيق المقاصد ذاتها. والترويج لعالمية هذه المبادىء - التى تتجاوز هذه التقاليد القانونية والثقافات والحضارات - خطوةٌ ضروريةٌ لضمان الامتثال للقانون الدولى الإنسانى.
وتَنَاوَلْتُ فى الفصل الخامس أثر الشريعة الإسلامية فى إنشاء وتطوير قواعد حقوق الإنسان فى القانون الدولى العام، وتبين أن الإسلام كان سبَّاقأ ً لتقرير حقوق الإنسان والتأكيد عليه، وأن هناك قدراً كبيراً مشتركاً بين حقوق الإنسان المدنية والسياسية فى القانون الدولى لحقوق الإنسان والشريعة الإسلامية,
وقد انتهيتُ إلى أن الشريعة الإسلامية صاحبة الفضل فى إنشاء وتطوير مبادىء وقواعد القانون الدولى العام ووضع العديد من أسسه ومبادئه موضع التطبيق.
After this previous presentation, it has become obvious to us the uniqueness of the Islamic law - in terms of its origins, sources, and methods of extracting rulings and applying them . However, the Islamic law represents the cornerstone on which Islam is based, and one of the international legal systems nowadays. As its provisions address all humanity members and all human groups everywhere and any time, also include the provisions of the local system and the provisions of the international system, and thanks to the inimitable characteristics of Islamic law, it was the main source on which the rules of the general international law are supplied.
And I have clarified that through this research entitled The Impact of the Islamic Law on Developing the Rules of The General International Law, through six chapters
In the introductory chapter, I explained the relationship between Islamic law and the general international law. It has became clear that Islamic law is based upon organizing matters of religion and the world together, also it has the advantage of taking the initiative in caring for the matter of organizing human relations between the various groups, and that what has settled human thought in formulating the rules of general international law is a product. I concluded the rules and principles that are included in Islamic law.
In the first chapter, I dealt with the role of the Islamic law in establishing the rules of the general international law and it was clearly stated that the sources of the international rule in general international law are clearly formulated from the original sources and dependence on the international rules in the Islamic law.
In the second chapter, I have dealt with the role of Islamic law in developing the rules that control the international system, and it was shown that the Islamic law has clearly contributed to establishing many modern international rules in many fields, besides the rules that organize the international relations.
In the third chapter, I have showed the role of the Islamic law in establishing general principles of the general international law, and that Islamic law includes principles that go with some general principles of the general international law. Among these principles are the principle of peaceful coexistence, the principle of non-interference in the internal affairs of countries, the principle of state sovereignty, and how the Islamic law has the great effect . The great role in establishing and configuring these principles.
In the fourth chapter, I have dealt with the effect of the Islamic law in developing the rules of the international humanitarian law in the general international law, clarifying the similarities between the principles on which the international humanitarian law is based and the provisions of war in Islam, and these two legal systems aim at achieving the same goals. Promoting globalize these principles that surpassed these legal traditions, cultures and civilizations is an inevitable step to guarantee conformity to the international humanitarian law.
In the fifth chapter, I have dealt with the effect of the Islamic law in establishing and developing human rights forms in general international law, it clarified that Islam was the first to determine and confirm human rights, and there was a a lot in common between civil and political human rights in the international human rights law and the Islamic law
