Abstract : In this thesis, I outlined what is meant by freedom of expression and its manifestations, guarantees and controls, and what is meant by publishing crimes and its general pillars. It was stated that the Islamic sharia preceded positive law in ensuring the freedom of expression and establishing grantees and disciplines to practice it. I clarified that the Islamic sharia includes the highest and most complete orders which can be applied at all times and places. One of the most important orders of sharia is to ensure the various freedoms of human starting with freedom of belief. In the modern era, constitutions and positive legislations were keen on the various rights and freedoms and also set guarantees and controls of practicing to preserve public order and public morals. These legislations tried to reconcile between freedom of expression and the rights and freedoms of others that could be attached when doing expression in publishing. This reconciliation does not mean limiting freedom of expression or other rights and freedoms, but it was intended to make a balance between them. This era shows scientific and technological advances which allow dissemination of different opinions and thoughts all over the world. However, this progress is a double-edged sword as it affects religion and morals and destroys societies, especially in Islamic countries, and this has resulted in the commission of many crimes through various written, audio, visual and electronic publications. These crimes are among the most serious types of crimes due to ease of access and impact on a large number of people. The publication crimes that were considered harmful to the public interest include: crimes of public incitement, crimes against public order and public morals, crimes of insult, shame and slander, crimes against the proper course of justice. I clarified the nature of each crime, its elements and penalties in Islamic sharia and positive law. The publication crimes that were considered harmful to individuals are divided into: the crime of public slander, the crime of public insult, the crime of assaulting private life, the crime of refraining from publishing a response or correction. I clarified the nature of each crime, its elements, its penalties, and the reasons for its permissibility in Islamic sharia and positive law.
