المستخلص
The Topic of Istihsan and its impact on the contemporary financial transactions are closely connected with reality and they shed light on one of the aspects of the science of Fiqh Fundamentals as well as the points of agreement and disagreement on the issue. Through this, the efforts of our predecessors and the accumulation of their experiences in the area of the fundamentalist thought are accentuated and their thinking approach is made clear. Besides, the provision of Sharia and its proposes are shown. This is one of the aspects of Ijtihad and renewal. This research has been divided into an introductory chapter and two parts: Introductory Chapter has been entitled “The Approach of legislating Isthsan as for fundamentalists” Part One: is showing what Istihsan is as for fundamentalists and it has been divided into four sections. Part Two: is showing the weaning of the contemporary financial transactions and the application of Istihsan to them and it has been divided into two Chapters. Finally at the end of the research, a number of results and some recommendations have been reached.
