This study aims to analyze and evaluate the conduct of the Egyptian legislator regarding the principle of equality between the father and the mother in the area of granting nationality to the children, and to identify the position of commentators law of the problem, by reviewing the policy of Egyptian lawmaker, and the considerations underlying the jurists.The study included some of the problems faced by the children of mother married to a foreigner, and social effects that result in the legislature to adopt certain policy, and the balance between maintaining the current situation or the need to modify it, and the way to do that.The study traced what applied in some nationality legislation comparison, both of which are consistent with Egypt in economic and social conditions, or those that agree with them in language, religion, history, customs and traditions.Finally, The study confirmed the position of the Egyptian legislator with regard to respect international obligations towards the international covenants on human rights related to the subject, through successive amendments made by the Egyptian nationality legislation in the last three decades.
